Federal law requires employers and commercial motor vehicle drivers to register in the FMCSA Clearinghouse.
The Clearinghouse is a secure online database that gives employers, the Federal Motor Carrier Safety Administration (FMCSA), State Driver Licensing Agencies (SDLAs), and State law enforcement personnel real-time information about driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. It makes it easier for employers to meet their pre-employment investigation requirements and comply with regulations, as well as for the FMCSA to determine employer compliance.
The Clearinghouse contains records of violations of drug and alcohol prohibitions in 49 CFR Part 382, Subpart B, including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty (RTD) process and follow-up testing plan, this information is also recorded in the Clearinghouse.
Federal law requires employers and commercial motor vehicle drivers to register in the FMCSA Clearinghouse. Third-party administrators (C/TPAs), medical review officers, and substance abuse professionals must also register.
A record of all queries must be kept on file, and companies may be asked to provide their records during an audit.
